While Escalante Outdoors, LLC and our affiliates (“Escalante Outdoors”) creates our products to be of excellent quality, by purchasing or using any of our products, you understand and agree that it is your obligation to ensure that such product is installed and used properly and in compliance with all applicable federal, state, local, and tribal laws and regulations.
A qualified professional should determine if our products are compatible with your vehicle and complete any installation. By purchasing or using our products, you understand and agree that installation of any after-market parts for your vehicle comes with risk, and you assume such risk and release any claims against Escalante Outdoors related to use of our products or any injuries or death to persons or damages to property related thereto.
Our products are intended for off-road use, where allowed by law. By purchasing or using our products, you agree to comply with applicable laws in any jurisdiction of use. Escalante Outdoors does not represent or warrant that your use of our products is allowed by law except as specifically stated herein, and we will not be liable for any penalties or fines related thereto.
By purchasing or using any of our products, you waive and release any and all claims against Escalante Outdoors related to the purchase, installation, or use of such product, and you agree to indemnify, defend, and hold harmless Escalante Outdoors and its affiliates from and against any and all claims, losses, damages, expenses, costs, and liabilities, including reasonable attorney fees and costs, arising from or related to (a) injury or death to any person or damage to any property resulting from or related to use of any of our products; (b) failure to comply with any applicable federal, state, local, or tribal law; (c) failure to comply with any vehicle owner manual; and/or (d) failure to comply with any of our terms or conditions.
This disclaimer shall be governed by and construed in accordance with the laws of the State of Utah, and any dispute arising from or in connection with this disclaimer or the purchase of any of our products shall be subject to the exclusive jurisdiction of the state or federal courts located in Salt Lake County, Utah.
